My Background

After my training as a wholesale and export merchant and upon completion of my translation studies (AKAD Stuttgart) with a degree as a state-certified translator at Saarland University in Saarbruecken, I became self-employed as a freelance translator in 1995. Since then, I have been translating from English/French into German with a focus on business/finance, marketing, advertising and technology/automotive, medicine/pharmaceuticals. For many years, an essential part of my work has been the content management for clients of these industries for websites, press articles, product catalogs, flyers and a lot more.
Over the years, I have established an extensive freelancer pool by working with translators and copywriters worldwide, so that today, after 30+ years, I am able to offer our services for almost all languages and industries. I attach particular importance to the selection of my freelancers, who must pass a strict qualification procedure before being assigned any projects for me and thus for my clients. The native language principle applies, i.e., we all work exclusively in/to our respective mother tongues.

Our Terms and Conditions 

GENERAL TERMS AND CONDITIONS FOR TRANSLATORS 

The general terms and conditions for translators in accordance with the recommendations of the BDÜ (Federal Association of Interpreters and Translators) apply: 

1. Scope 

(1) These terms and conditions apply to contracts between the translator and their client, unless otherwise expressly agreed or required by law. 

(2) The client's general terms and conditions are only binding for the translator if he has expressly accepted them. 

2. Scope of the translation assignment 

The translation will be carried out carefully in accordance with the principles of proper professional practice. 

The client will receive the contractually agreed copy of the translation. 

3. Client's obligation to cooperate and provide information 

(1) The client shall inform the translator in good time of the desired form of the translation (intended use, delivery on data carriers, number of copies, readiness for printing, external form of the translation, etc.). If the translation is intended for printing, the client shall provide the translator with a proof copy in good time before going to press so that the translator can correct any errors. Names and numbers shall be checked by the client. 

(2) The client shall provide the translator with the information and documents necessary for the translation when placing the order (client's terminology, illustrations, drawings, tables, abbreviations, internal terms, etc.). 

(3) Errors and delays resulting from the lack of or delayed delivery of information material and instructions shall not be borne by the translator. 

(4) The client shall assume liability for the rights to a text and ensure that a translation may be produced. The client shall indemnify the translator against any corresponding claims by third parties. 

4. Rights of the client in the event of defects 

(1) The translator reserves the right to remedy any defects. The client is initially only entitled to the removal of any defects contained in the translation. 

(2) The client must assert the claim for the removal of defects, specifying the exact nature of the 

defect. 

(3) If the translator does not remedy the asserted defects within a reasonable period of time, or if he refuses to remedy the defects, or if the remedy of the defects is to be regarded as having failed, the client may, after consulting the contractor, have the defects remedied by another translator at the contractor's expense or, alternatively, demand a reduction in payment or withdraw from the contract. The remedy of defects shall be deemed to have failed if the translation still contains defects after several attempts at correction. 

5. Liability 

(1) The translator shall be liable in cases of gross negligence and intent. Damage caused by computer failures and transmission errors when sending e-mails or by viruses shall not be classified as gross negligence. The translator shall take precautions against this by using anti-virus software. Liability for slight negligence shall apply exclusively in the event of a breach of primary obligations. 

(2) The client's claim against the translator for compensation for damage caused in accordance with No. 5 (1) 

sentence 4 is limited to EUR 5,000; in individual cases, a higher claim for damages may be expressly agreed.

(3) The exclusion or limitation of liability under No. 5 (1) and (2) shall not apply to damages suffered by a consumer as a result of injury to life, limb, or health. 

(4) Claims by the client against the translator for defects in the translation (Section 634a BGB) shall become time-barred one year after acceptance of the translation, unless there is evidence of fraudulent intent. 

(5) Contrary to § 634a BGB, liability for consequential damages shall be limited to the statutory limitation period. This shall not affect § 202 (1) BGB. 

6. Professional secrecy 

The translator undertakes to maintain confidentiality regarding all facts that become known to him in connection with his work for the client. 

7. Involvement of third parties 

(1) The translator is entitled to engage employees or expert third parties to carry out the order. 

(2) If expert third parties are engaged, the translator must ensure that they undertake to maintain confidentiality in accordance with No. 6. 

8. Remuneration 

(1) The translator's invoices are due and payable without deduction within 14 days upon date of invoice. 

(2) All prices are net plus statutory sales tax. 

(3) In addition to the agreed fee, the translator is entitled to reimbursement of expenses actually incurred and agreed with the client. In all cases, value added tax will be charged additionally, if required by law. The translator may request a reasonable advance payment for extensive translations. The translator may agree in advance with the client in writing that the delivery of his work is dependent on the prior payment of his full fee. 

(4) If the amount of the fee has not been agreed, a reasonable and customary remuneration appropriate to the type and difficulty of the work is owed. This shall not be less than the applicable rates of the German Judicial Remuneration and Compensation Act (JVEG). 

9. Retention of title and copyright 

(1) The translation remains the property of the translator until full payment has been made. Until then, the client has no right of use. 

(2) The translator reserves any copyright that may have arisen. 

10. Right of withdrawal 

If the translation order is based on the translator having offered translation services on the Internet, the client waives any right of withdrawal they may have in the event that the translator has started the translation work and notified the client thereof. 

11. Applicable law 

(1) German law applies to the order and all claims arising from it. 

(2) The place of performance is the translator's place of residence or the location of their professional establishment. 

(3) The place of jurisdiction is the place of performance. 

(4) The contract language is German. 

12. Severability clause 

The validity of these terms and conditions shall not be affected by the invalidity or ineffectiveness of individual provisions. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic result or the intended purpose. 

13. Amendments and additions

Amendments and additions to these General Terms and Conditions are only valid if they have been agreed in writing. This also applies to any amendment to the written form requirement itself.
